Law Enforcement Webinar 

In this webinar, health information geeks (and lawyers) Jennifer Hennessy and Scott Thill will shed light on the multi-layered legal parameters and limitations that go into forming a good solid policy about disclosures to law enforcement by HIPAA covered entities and their business associates, in Wisconsin.  Among other concepts we will discuss:

  • How HIPAA connects with Wisconsin law with regard to law enforcement (and whether "HIPAA Harmonization" changed anything)
  • When may providers contact police about patients without violating HIPAA or Wisconsin law?
  • How to handle police requests to talk to a given patient onsite or to get information about a patient's whereabouts or condition.
  • How to handle police requests to be notified in advance if patient is to be discharged.
  • Factors to consider in assessing imminent danger/ emergency disclosure.
  • Emergency detention / protective custody for patients intoxicated by alcohol.

Who Should Attend:

  • New Privacy Officers at covered entities (providers, payers, and clearinghouses).
  • Existing Privacy Officers desiring a “refresher” on disclosing patient information to law enforcement under HIPAA and Wisconsin law.
  • Any others who have a need for a basic understanding of safeguarding the privacy of protected health information and the circumstances under which disclosures of this information to law enforcement is permissible. 

Presenters:

 Jennifer J. Hennessy is an associate with Quarles & Brady, LLP in the Madison, Wisconsin office. Her areas of expertise include advising health care providers, health plans, and other companies on federal and state privacy and security issues, including drafting privacy and security policies and assisting with security breach investigations and the notification process.  She holds a B.S. in Political Science from the University of Iowa, a J.D. from the University of Iowa College of Law, and an M.B.A. from the University of Iowa Tippie School of Management, and is a member of the American Bar Association, the State Bar of Wisconsin, the American Health Lawyers Association, and the International Association of Privacy Professionals.  Jennifer is a frequent speaker and author on privacy and security issues. 

Scott J. Thill is an attorney in the Health Care Practice Group in Godfrey & Kahn, S.C.’s Green Bay office.  Scott’s practice focuses on handling a variety of health care matters, including HIPAA issues, regulatory compliance issues, and Stark and Anti-Kickback Statute issues.  Scott’s HIPAA experience includes advising covered entities and business associates on their HIPAA obligations, drafting HIPAA policies and advising clients on breach investigations.  Scott obtained both his J.D. and M.H.A. degree from the University of Iowa.  Scott has presented at a number of HIPAA conferences and seminars throughout the state of Wisconsin.
