The Georgia Brownfield Association (GBA) submitted a draft whitepaper to GA EPD in 2016 requesting the GA EPD consider how the following interpretation of the Georgia Brownfield Program (GBP) and the Voluntary Remediation Program (VRP) laws could encourage even more redevelopment of brownfield properties across Georgia.
Properties enrolled in the GBP can be remediated and certified to meet appropriate HSRA standards, using either 1) the risk-based VRP approach, 2) the restoration-based traditional HSRA approach, or 3) any combination thereof, while maintaining eligibility for the limitation or liability available under the GBP.
The GA EPD indicated that they were not comfortable allowing all forms of the risk based tools allowed for under the VRP to be used on all properties enrolled in the GBP. However, the GA EPD did indicate that they would consider the use of some risk based elements from the VRP for broad application and other risk based elements on a site-by-site basis. EPD recommended we revise the white paper to address the risk based tools most important to participants of the brownfield program. In addition, EPD encouraged GBA to review the HSRA regulations to develop a summary of potential edits/changes to the HSRA rules that would be helpful to the GBA. As such, GBA wishes to engage GBA members to gain feedback on two questions:
