Affordable Care Act and DOMA Seminar 

There have been many stories in the news recently regarding healthcare reform (The Affordable Care Act, or ACA) and the recent U.S. Supreme Court decisions on same sex marriage and the Defense of Marriage Act (DOMA). These developments will have a significant impact on employers. Please join us on August 8, 2013 from 8:30 a.m. to 10:30 a.m. for an update on ACA and DOMA and what employers should do now.  

We will review ACA provisions becoming effective in 2014, such as:

  • The Individual Mandate:  All individuals are required to have health insurance coverage in 2014;
  • The 90 Day Waiting Period Limit:  Eligible employees must be permitted to join an employer’s health insurance plan within 90 days of the date of hire;
  • Exchange Notices:  Employers must provide to all employees a notice by October 1, 2013 containing information about health insurance exchanges including Connecticut’s exchange “Access Health CT”; and
  • Wellness Programs:  Provisions allowing increases in the rewards available to employees who meet wellness program requirements.  

We will also discuss the 2014 ACA provisions that have been delayed, such as:

  • Enforcement of the employer mandate penalties; and
  • Certain employer reporting requirements

In addition, we will provide guidance on how the Supreme Court cases on same sex marriage affect employee benefit plans and policies. We are expecting direction from the IRS on whether amendments will be required to various retirement and benefit plans now that same sex spouses must be recognized under federal laws such as the Internal Revenue Code.
