Lifting the Corporate Veil in the Recognition & Enforcement of Foreign Judgments: Approaches in the United States and Canada
In Canada, plaintiffs seek to enforce a judgment obtained in Ecuador against Chevron Corporation for injury allegedly caused in Ecuador and also to hold Chevron Canada, a subsidary that did nothing in Ecuador, liable for the judgment. In the United States, a Dutch company is seeking to enforce a Swiss arbitral award against a Turkish company, Çukurova Holding A.S., arising out of a transaction in Turkey. The connection to the United States was argued to be the American activities of Çukurova affiliates. These two cases, among others, will provide a platform for a more general discussion of recent efforts by plaintiffs to hold affiliates within a corporate group responsible for each other's actions.
