Elder investors - vulnerable investors - persons with fluctuating
or diminished mental capacity and adults are subject to undue
influence or financial exploitation.
Financial advisors and the investment industry are key players in the detecting and reporting of elder financial abuse, and other forms of undue influence. However, the current law restricts how these financial planners and investment advisors can reach out or express their concerns, without breaching privacy law.
* Overview of the FAIR Project, the consultation process and why these issues
need to be addressed and appropriate action taken.
* Understanding what is meant by 'undue influence' and how families, bank staff
and investors can identify when it is occurring.
* What are the key issues around diminished capacity and financial management,
specifically from the perspective of financial institutions.
* Options for intervention (with banks and financial advisors/investors) when
financial abuse of vulnerable investors is suspected.
* Review of key recommendations to support vulnerable investors and the
significance of making these changes.
