"On March 13, 2014, the Florida Supreme Court handed down a ruling
(Estate of McCall v. United States), that held the cap on non-economic
damages in medical malpractice cases (which was the centerpiece of the
2003 medical malpractice overhaul law) violates the Florida
Constitution's Equal Protection clause. To clarify, non-economic
damages are those nebulous harms such as "mental anguish, emotional
pain and suffering, loss of companionship, loss of consortium, or
other nonpecuniary injury." From a practical standpoint this means
that a Florida physician sued for malpractice could now face a
multi-million dollar judgment. In fact, the McCalls were awarded 2
million dollars in non-economic damages alone. This makes protecting
assets even more important to physicians practicing medicine in
Florida.
