Aftershock: Property and Business Interruption (BI) Claims Issues in the Aftermath of Historic 2011 Catastrophes    

 Dempsey Partners will share their perspective on the challenges - and opportunities - arising from the myriad of issues that continually arise in the aftermath of catastrophe claims.  Many claim settlements are slowed down and disputes often arise over the following areas which will be discussed:

- definition and tiers for suppliers and customers on contingent BI claims

- service interruption and resulting rolling black-outs

- commodity cost increases

- local international policies and global master policies and how they relate (or not)

- loss of market exclusion

- intertwining of perils that often occur together such as tsunami and EQ or hurricane and flood, and how various deductibles and sublimits are applied.

Jeff  M. Phillips

Jeffrey M. Phillips, is a Partner in Dempsey Partners’ Southern California office and is responsible for the firm’s Western Region Property Damage claims practice. He is a licensed professional engineer with experience in underwriting, loss prevention, and property claims, and provides property damage claims services to the manufacturing, hospitality, real estate, energy, and technology sectors. His experience encompasses catastrophic claims arising from earthquakes, hurricanes, and the terrorist events of 9/11.

All told, he is responsible for the recovery of over $1.5 billion in property and business interruption claims. With over 22 years of experience in the commercial insurance industry, Mr. Phillips has an extensive background assisting clients with large property damage and business interruption insurance claims, fidelity claims and other risk evaluations and disputes. Prior to his work assisting policyholders with claims, Mr. Phillips spent over ten years with a large commercial property insurance company in various positions including eight years as a claims adjuster. As an adjuster, Mr. Phillips negotiated settlement of hundreds of large insurance claims. This experience provided him with in depth training in insurance coverage, claims procedures, project management, loss investigation, and negotiation. Mr. Phillips now utilizes this deep understanding of the insurance claims process to level the playing field for policyholders, spending the last 12 years assisting clients develop successful strategies for risk evaluation, claim management, resolution of complex coverage and loss measurement issues and other disputes. In addition, Mr. Phillips utilizes his underwriting and coverage experience to assist clients with pre-loss policy reviews, insured value and sub-limit analysis, risk exposure and probable maximum loss evaluations.

Mr. Phillips is a graduate of Arizona State University and holds a Bachelor of Science degree in Mechanical Engineering. He is a registered Professional Engineer in the state of California.

Eric Sullivan, CPA

Eric S. Sullivan, CPA is the partner-in-charge of the firm’s San Francisco office. With eighteen years of forensic accounting and investigative experience, Mr. Sullivan has represented numerous major corporations in the analysis and presentation of complex business interruption, property, and fidelity claims.

Mr. Sullivan began his career in 1994 as a staff accountant in the Wilton, Connecticut office of Dempsey, Myers and Company. In 1998, he participated in the opening of the San Francisco office and became a partner of Dempsey Myers in 2005. In 2008, Mr. Sullivan helped found Dempsey Partners LLC.

Traveling throughout the United States and internationally, Mr. Sullivan has prepared complex business interruption claims for clients in a variety of industries including healthcare, technology, pulp and paper, retail, manufacturing, hospitality, and mining among others. In 2005, Mr. Sullivan was engaged to handle all of the property damage and business interruption losses throughout the area affected by Hurricane Katriana for the nation’s largest independent provider of dialysis services. This included losses for over 25 clinics with damages caused by wind, flood, and service interruption. Since then, Mr. Sullivan has prepared losses related to fire, tornado and flood at various clinics throughout the United States.

Mr. Sullivan currently represents several national retailers in the preparation of claims involving property damage and business interruption losses to stores throughout the United States and Canada. For each engagement he leads the claim process from the accountant’s review of the loss amounts through successful resolution. Mr. Sullivan has also acted as the lead accountant in the preparation of business interruption and property damage claims of one of the largest hospitals in the Houston area for losses arising from tropical storm Allison. Additionally, he was responsible for the preparation of documentation to support claims made to the Federal Emergency Management Agency. Recovery from insurance and FEMA was in excess of $150 million.
