Florida passed the Collaborative Law Process Act during its 2016 legislative session. In it, the Florida Legislature has taken steps to provide a fundamentally different, a more civil and less contentious dispute resolution process for families in conflict, stating that its purpose was to: 

1. Create a uniform system of practice for a collaborative law process for proceedings under chapters 61 and 742 of the Florida Statutes

2. Encourage the peaceful resolution of disputes and the early settlement of pending litigation through voluntary settlement procedures.

3. Preserve the working relationship between parties to a dispute through a non-adversarial method that reduces the emotional and financial toll of litigation. 

Florida is the 15th state in the nation to adopt a version of the act. Civil practitioners elsewhere have already begun applying the collaborative process for their clients. Don’t be left eating their dust. Be prepared when a client asks you whether you are trained in this area of dispute resolution.
