A Virtual, Halloween-Themed Walk to Celebrate Stroke Survivors 

By registering you agree to our Participant Release, Conset to Release Photography/Filming Waiver of Liability and Indemnity Agreement.

PARTICIPANT RELEASE, CONSENT TO RELEASE PHOTOGRAPHY/FILMING, 
WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

This Participant Release, Consent to Release Photography/Filming, Waiver of Liability and Indemnity Agreement is being given in connection with my participation in the Virtual Stride On Walk hosted by Select Medical and its owned and managed inpatient rehabilitation hospitals (collectively “SMC”), from October 1, through October 28, 2021 (“Walk”), in which I am participating voluntarily and of my own free will. As a condition of my participation, SMC has required, and I have confirmed from my physician, that I do not have medical issues that would disqualify me from participating in this Walk. 

Through my registration and participation in the Walk, and by posting and/or sharing images, photographs, comments or videos (“Content”) with SMC through the Walk and/or SMC’s social platforms or websites, I authorize SMC to use such Content and any reproductions or adaptations of the images, for marketing and/or public relations, in such manner as may be deemed necessary by SMC. I agree that I have obtained the consent of any other individual who is present in any of the Content shared with SMC. SMC has my permission and the absolute right to copyright, publish, post, broadcast, reproduce, or use in any manner, in whole or in part, any and all Content shared by me relating to the Walk. I understand that the above mentioned materials may be used on social media. This may include, but is not limited to: Facebook, Twitter, Instagram, Google+ etc. 

I covenant not to sue and release, waive, discharge SMC, their respective members,  subsidiaries and affiliates, and their officers, agents, and employees (collectively, referred to as “Releasees”), from all liability to myself, my personal representatives, assigns, executors, heirs, and next of kin for any and all claims, demands, losses or damages on account of any injury, including, but not limited to death or injury or damage to property, all of which is caused or alleged to be caused in whole or in part by the negligence of the Releasees or any third parties or otherwise.

I hereby assume full responsibility for and risk of bodily injury, death or property damage due to negligence of Releasees or otherwise while at the Walk. 

I hereby agree to indemnify, save, and hold harmless the Releasees from any loss, liability, damage or cost that may occur due in any manner or degree to my participation in the Walk, or my sharing of Content with SMC, whether caused by negligence of the Releasees, third parties, or otherwise.

I agree this Participant Release, Consent to Release Photography/Filming, Waiver of Liability and Indemnity Agreement extends to all acts of negligence by the Releasees, and is intended to be as broad and inclusive as is permitted by the law of the State of Delaware. If any portion thereof is held invalid, it is agreed the balance shall, notwithstanding, continue in full legal force and effect.

IT IS MY INTENTION BY SIGNING BELOW TO EXPRESSLY ASSUME ALL RISK OF PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE UPON MYSELF, TO THE EXCLUSION OF SMC, AND TO EXEMPT AND RELIEVE SMC FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH.
