Are you challenged when it comes to managing the interactive process with employees experiencing medical conditions?  Are you uncertain on what to say, how to proceed, and what you can and cannot ask? Well, you're not alone! 

HI! I’m Dr. Debra Dupree.  I'm a former Vocational Rehabilition Counselor, Certified Case Manager, and Certified Professional in Disability Management along with 25 years of Workplace Mediation.  I am passionate about helping employers and employees navigate through the colliding worlds of ADA, FEHA, Workers' Compensation, FMLA, and the Education Code when medical conditions develop.   I am dedicated to bringing sensibility to the process, objective evidence, and compassion for people when "stuff" happens!

Although the ADA has been around since 1990 (and FEHA even longer), how to interpret and what to do remains the subject of many a lawsuits that lead to changes in practice.  The interactive process IS required of all employers under the Americans with Disabilities Act (ADA) and the California Fair Employment Act (FEHA) WHENEVER they have knowledge of an employee's medical condition that may impact their ability to BE at work, STAY at work, and PERFORM the work.  

How does an employer approach an employee about confidential medical information?  
  • What is the employer's obligation under Federal and State Laws?  
  • What happens when it's a work-related injury...not work-related?
  • What can an employer ask and allowed to know when medical conditions impact the ability to be at work, stay at work and perform the work?
  • What about the Education Code and FMLA?
The process really hasn’t changed much over nearly 30 years of implementation, however, it continues to evolve as case law is established when employer practices are challenged and/or when they FAIL to engage in the interactive process or explore reasonable accommodation.
