Preparing for Arbitrations and Mediations

Arbitrations:

  • Understanding the procedural differences between different types of arbitrations: Union; Arbitrations arising out of private contracts and arbitration agreements; Private arbitration service providers; Court initiated arbitrations
  • Being Prepared:  best practices when preparing for an arbitration
  • Understanding the differences between litigation and arbitration:  what rules apply? Rules of Evidence? Rules of Civil procedure? Privilege? Use of subpoenas? Discovery? Enforcement of an arbitration award

Mediations:

  • Factors to consider in selecting a mediator who will be the best fit for your case
  • What information does the mediator need in advance of the mediation?
  • Confidentiality issues during the mediation
  • Best practices when participating in a mediation
  • What happens if the case does not settle?
  • Benefits of a mediation even when the case does not resolve
