Collections will concentrate on the creation, attachment, recording and enforcement of liens on chattel collateral under the UCC. Statutory liens on deposits, inapplicable claims of exemption, pitfalls in replying to members' account disputes, risks of waiver, flawed default determinations, flawed notices and venue considerations civil judgments will also be covered.

Bankruptcy will cover issues first in Ch. 7 and then in Ch. 13. A ten-step process to address any bankruptcy within the first 4 hours following receipt of any word the member has bankrupted will be provided. When, how and why to communicate with a bankrupted debtor and the risks of stay violation will be addressed. Finally, the right way to file Proofs of Claim will be explained in detail.

Franklin Drake has practiced in the Raleigh, North Carolina law firm of Smith Debnam Narron Drake Saintsing & Myers for 25 years, following a sixteen year practice specializing in creditor's rights, bankruptcy, and repossession law in Louisville, Kentucky.

Mr. Drake graduated from the University of North Carolina in 1975 with a B.A. withhonors and with his law degree in 1978. He has practiced in North Carolina, Kentucky, West Virginia and the federal courts of southern Indiana.
