Navigating Patient Placement Ethics

"The law and Public Policy of Behavioral Healthcare"

Identifying patients who are appropriate for placement within a clinical program is often left up to outreach personnel (“marketers”) who frequently do not have clinical education.  As a result of the nature of what is referred to as “patient acquisition,” clinicians are unaware whether the patient has voluntarily selected their group practice for therapeutic services.  While facility owners are held accountable for the actions of the marketers they employ, what role and responsibility does the therapist have both to the patient/client as well as to protect their own personal licensure? The presenter will demonstrate the challenges posed by the free marketplace for patients and therapists in the drug and alcohol treatment space in particular, and what role therapists can play to ensure patients are on the road to sustainable recovery.

About Our Presenter

Jeff Lynne Bio Picture Jeffrey C. Lynne, Esq. is a law partner in the Boca Raton, Florida, lawfirm of Beighley, Myrick, Udell & Lynne, P.A., with a Florida-based consulting practice focused upon zoning, rea  l estate, business structuring, marketing, licensing, regulatory compliance and litigation in the Substance Use Disorder treatment and sober living residence provider spaces. Jeffrey has been recognized across the nation as a sought-after speaker and thought leader in the progressive public dialogue about the role that Substance Use Disorder treatment has within our communities and the fundamental need and right to provide safe and affordable housing for those who are both in treatment as well as those who are established in their recovery. He was appointed by Palm Beach State Attorney Dave Aronberg to serve on the Sober Homes Task Force for his in-depth knowledge of industry practices and for his long-standing reputation in the South Florida community for legal ethics. Jeffrey is also the author of the blog “SoberLawNews.com” where he discusses emerging legal and business trends in behavioral health care treatment, housing, and marketing practices. Jeffrey is a former state prosecutor in Miami, Florida; a former city attorney for the City of Boca Raton, Florida; and was a shareholder at a national law firm of Akerman, LLP. Jeffrey graduated from the University of Miami School of Law and from the University of Florida, where he majored in Criminal Justice.
