"Up Close and Personal with the EEOC"



Guest speaker Ralph Charles has gained a reputation for resolving the most contentious matters in the district. His presentation will:

  • Outline the process that occurs when a complaint is filed with the EEOC, from how investigators develop cases to the assignment of cases to the mediation unit, as well as the possible assignment of cases to the litigation unit.
  • Detail what type of information investigators seek during an investigation and the proactive steps employers can take to provide the requested information and protect themselves.
  • Explore a number of hot-topic issues, including:
    • “Ban-the-box” – How companies should handle their hiring applications and interview process in terms of criminal records and the history of applicants
    • The Americans with Disabilities Act (ADA) – How companies should calculate an undue hardship in financial terms in the event a company is alleged to have not provided a reasonable accommodation to a disabled employee
    • Important restrictive covenants to include in arbitration agreements, and what covenants are not enforceable
    • Gender equality and the rights of the transgender community, including the current discussion on “bathroom laws” and equal opportunity in promotions
    • Adequate training for employees, managers and supervisors regarding the rights, responsibilities, and remedies available under employment discrimination laws
    • Title VII of the Civil Rights Act of 1964, hostile work environments, employer retaliation, hiring and termination, promotion and advancement, issues related to pregnancy, etc.

Federal Mediator, ADR Unit, US EEOC, Newark Area Office

Ralph Charles is a Federal Mediator for the U.S. Equal Employment Opportunity Commission (EEOC) in the Newark Area Office, where he manages the Alternative Dispute Resolution (ADR) unit.  Mr. Charles serves as an extern supervisor for numerous graduate level programs in labor & employment, law, and business for schools in the tri-state region. In addition, he chairs the Cultural Diversity committee for the Federal Executive Board of Metro Northern NJ (FEB). 



The EEOC is the federal agency responsible for enforcing federal laws prohibiting discrimination in the workplace based on race, color, religion, national origin, sex, age, and disability status. The Newark Area Office has jurisdiction over 13 NJ counties: Bergen, Essex, Hudson, Hunterdon, Mercer, Middlesex, Monmouth, Morris, Passaic, Somerset, Sussex, Union, and Warren. 

EEOC mediators in the ADR Unit facilitate negotiation and settlement between disputing parties by providing direction and encouragement, working collaboratively with the parties, and finding creative ways to reach a mutual solution. They serve as a neutral party in mediating employment, labor, and civil claims arising out of discrimination charges.
