This presentation will address the theories of joint liability typically pursued by homeowners associations and legal defenses thereto, with a focus on recent court decisions.
Cases involving claims of construction defects often include claims against the builder and subcontractors as well as the design team. Frequently, homeowners and homeowner associations allege that the builder, subcontractors, and designers are jointly liable for the defects and damages that resulted. This program will review the legal arguments advanced by homeowners and homeowner associations, as well as the arguments made against the imposition of joint liability. We will also review some recent trial court decisions and engage the audience in a discussion of whether joint liability should be imposed, whether the legal elements can be met, and the most effective defense.
