Social Media: How to Find It and Use It

This CLE will focus on identifying and capturing sources of social media and addressing objections to admissibility of such evidence at trial. The first step in the process is finding the person online. Some searches will yield a wealth of information that is publicly available, and some will simply identify the sites where a person has private accounts. Attorneys will learn about where to look and the extent of information that may be available for a person.
How to capture the social media will also be addressed. With the use of new software and technology, attorneys will learn how to forensically capture the social media they find to confirm its authenticity.
Finally, alternatives for admitting evidence of social media will be discussed, from the pros and cons to disclosing such evidence before trial or using such evidence as impeachment evidence. Attorneys will also consider how to answer objections to admissibility of such evidence at trial.
