Mediation is an oft used technique which can effectively resolve disputes. In this participatory session, which is illustrated by video vignettes, attendees will discuss various common ethical issues that arise during mediation, such as adequate preparation, candor and truthfulness in the proceedings as opposed to lying or “bluffing”, confidentiality issues, potential conflicts of interest, and attorney and/or party misconduct.
