 Teaching through war stories. What can we learn from a case where an absolute perfect storm of issues arose involving hospital liens, the made whole statute, tri-partite relationships, waivers, excess exposure, Nunn-Bashor agreements, and bad faith? Using an actual case, the presenters will discuss the hospital lien exception to the 'made whole' statute and problems it creates; problems of the tri-partite relationship forming the basis for a bad faith instruction; and the ever-present efforts of some counsel to 'set up' bad faith suits where coverage is considered inadequate.
