With the advent of the COVID-19 pandemic, the necessity to explore alternate means of securing, preserving and presenting evidence in the world of civil litigation has become paramount.  Colorado Rule of Professional Conduct 1.1 mandates that a lawyer “shall provide competent representation.”  Comment 8 to RPC 1.1 mandates that competence requires a lawyer to “keep abreast of changes in the law and its practice, and changes in communications and other relevant technologies.”

This seminar will examine the ethics, efficacy and shortcomings of conducting a civil trial remotely and securing and preserving evident through the remote deposition.  CDLA member Kevin Kennedy has the unique experience of actually presenting a civil trial via Webex.  He will share his experience and insight as it pertains to the unique challenges and strategy inherent to the virtual trial.

The seminar also will address the ethics, strategy and challenges of the virtual deposition.  This will include both the defense of a client, the deposition of the plaintiff, and expert depositions.  The seminar also will include a discussion of other member’s experience in such a forum, trends in District Court rulings, and the future of the practice as society stumbles forward in the wake of the pandemic and the new civil practice that likely will emerge from this unique time.
