Insurance carriers have a right to expect the cooperation of their insureds in first party claims based as a contractual obligation. The Colorado Legislature, pursuant to CRS §42-7-414 has required carriers to provide notice of any failure to cooperate and a subsequent notice to cure that could result in this defense being taken away for claims and removed as a tool for the attorneys retained to defend statutory insurance claims and claims of bad faith. The panel will discuss the statute, advice for your carrier clients, and handling the failure to cooperate in litigation.
