Maintaining Standards of Professionalism in Dealing with Opposing Counsel:
Keeping Your Cool

When Opposing Counsel Isn't

Thursday, February 11, 2021 from 4:05 to 5:05 PM

Presented by:
Justice Richard Gabriel, Colorado Supreme Court
Gina Rossi and Mamie Ling, Hall & Evans LLC
Haley Maglieri, Messner Reeves LLP
Reid Jennings, Parrish Jennings, LLC

1 hour CLE applied for / CDLA Members Only Please

The presentation will focus on tactics and practice tips for younger attorneys, often female, when dealing with patronizing and aggressive opposing counsel who are demeaning or otherwise unprofessional. The presentation will focus on how to react, control yourself, and put your best self forward while in those situations. We will cover applicable rules (rules of professional responsibility, local rules, etc.) and what more seasoned attorneys can do to help mentor the younger attorneys and support them in these situations. We will also provide insight on conduct that attorneys may not realize amounts to patronizing or demeaning to help foster awareness.

There will be four ten-minute segments addressing how to handle these situations in different settings, namely: 1) Verbal Confrontations (phone calls and depositions); (2) Written Confrontations (emails, letters); (3) Court Confrontations (briefing and in person); and (4) Seasoned Counsel Support. Then, for the last twenty or so minutes, we will have Mamie Ling serve as a moderator and pose questions she has gathered from younger counsel and CDLA members.
