Small Business Protests -

What, When, Where and How

Course Description

     Bid protests are a common--and increasing--occurrence in many federal procurements, with 2,475 protests filed at the Government Accountability Office (GAO) in 2012, an increase of 5% over 2011.

     Specifically designed for small business concerns, this course will provide a roadmap of the Federal procurement protest process from start to finish in all of the relevant forums, including the Small Business Administration (SBA).

     Get up-to-date on the rules, procedures, substantive and procedural requirements, and strategy involved in the various protest forums - the agency, the GAO, the U.S. Court of Federal Claims, and the SBA. Exercising your preaward and postaward debriefing options in negotiated procurements will be covered to help you establish grounds for protest.

     Practical advice on a variety of protest related topics, such as:

  • what you must do to obtain a contract suspension
  • how to use the rule of two to your advantage
  • when should you challenge a modification to an existing contract.

     Learn what, when, where and how to protest Federal procurements. Protests at the SBA both challenging the size standard assigned to a particular procurement and the size of an awardee will be covered, including the SBA’s affiliation rules.

Our Instructor

     John Tolle is the managing partner of the McLean, Virginia law firm of Barton, Baker, Thomas & Tolle, where he devotes his practice to all aspects of Government contracts and small business issues. He is a member of the Government Contracts Section of the Federal Bar Association. John has been our instructor for Teaming Agreements, Subcontracts, and Small Business Protest workshops for over five years. For ten years, John was an adjunct professor at the University of Virginia, where he developed and taught a course entitled Government Contracts Computer Law.
