Protecting Your Business Family from Family Law Claims

Family law issues have special importance for the owners of family businesses, as business interests are ‘property’ under Ontario family law. Proactive planning prior to marriage, turning one’s mind to family law issues as business interests grow and change during marriage, and careful management of issues surrounding the business upon separation are critical to protecting business interests from potential family law claims. With family businesses in particular, where there can be generations of investment and careful planning for the future, ensuring that family law issues are sensitively and effectively anticipated and managed is vital.

Through the session, participants will be introduced to family law topics of special interest to family business owners. The goal is to provide participants with an understanding of how to best protect their assets and their business at all stages of their relationship with their spouse.

This seminar will address four key issues:

1. the process for property division in Ontario
2. the potential uses and effects of marriage contracts in protecting business interests from property division;
3. special issues around gifted and inherited shares; and,
4. options for quickly and confidentially dealing with relationship breakdown.
