Course Description: This webinar will provide guidance to university general counsel, athletics administrators and other higher-education professionals on the evidentiary and procedural principles, decisions and framework of the NCAA Committees on Infractions and Infractions Appeals Committees. Specifically, presenter Michael Buckner, a higher-education and sports law attorney with significant NCAA infractions hearing experience, will cover the committees’ case-precedent regarding evidentiary issues and procedural standards, including, but not limited to: affidavits; notices of appeal; hearing appearances; clerical errors; conflicts of interest; due and fair process; evidence rules; hearing record; transcripts; inadmissible information; adequate notice; hearing objections; penalties; reliability and credibility of information; right to legal counsel; standard of proof; standing; and witness testimony. Throughout the webinar, Mr. Buckner will offer tips on avoiding evidentiary and procedural errors during the enforcement process.

This program has been approved for CLE credit in Texas. Buckner will apply for continuing legal education credit (CLE) for this event in the following jurisdiction: California and Florida.

Course Objectives and Benefits: The webinar will provide guidance to university general counsel, athletics administrators and other higher-education professionals on the evidentiary and procedural principles, decisions and framework of the NCAA Committees on Infractions and Infractions Appeals Committees. Specifically, using hypotheticals based on real-life events, as well as insight from prior infractions cases, webinar participants will cover:

• Strategies to address evidentiary issues prior to and during an infractions hearing
  
• Best practices to minimize procedural errors during an enforcement case.
