James B. Sherman, Esq.
 JAMES B. SHERMAN is the President and CEO of Wessels Sherman. He has over 20 years of experience counseling businesses. He has successfully litigated many precedent-setting federal and state court cases, and represented employers of all sizes before a wide array of federal and state administrative agencies in over 20 states. Mr. Sherman is a frequent speaker to business and Human Resource groups and does in-house training on a variety of important workplace topics. Mr. Sherman has also been selected to the 2015 Super Lawyers List.

Chad A. Staul, Esq.
CHAD A. STAUL is a Senior Attorney in Wessels Sherman's Minnesota office. He focuses his practice on employment litigation, representing clients in both state and federal courts, as well as before the EEOC and other federal, state and local agencies. He has defended employers against claims involving workplace discrimination, harassment, retaliation, wage and hour claims, common law tort claims, and breach of contract, including claims involving non-compete and non-solicitation agreements. Mr. Staul has also been selected as a 2015 Rising Star by Super Lawyers.

Phoebe A. Taurick, Esq.
PHOEBE A. TAURICK is an Associate Attorney in Wessels Sherman's Minnesota office. She is licensed to practice law in the State of Wisconsin and both State and Federal courts in Minnesota. Her practice is focused on representing management in all aspects of labor and employment law, including NLRB and other state and federal agency matters. During law school, Phoebe concentrated her studies in the field of labor and employment law and gained valuable experience while serving as an intern with the EEOC and a public sector labor organization. Additionally, she received the BNA-ABA Award for Excellence in the Study of Labor and Employment Law.

This session will bring you up to speed on recent legal developments affecting employers, from the Supreme Court, the EEOC, the NLRB, the legislature, and more.  Topics to be covered include:

  • First several months of the NLRB’s “ambush election” rule;
  • Gender-related issues, including pregnancy, transgender employees, and same-sex marriage; and
  • Landmark Supreme Court decisions on the ACA, religion and EEOC authority.

9:30-10:00 – Background Checks and Hiring Practices (Staul)

More and more employers are facing class action lawsuits regarding their background check and other hiring practices.  Learn how to avoid these common and costly mistakes many employers make.

10:10-10:40 – Disciplining and Discharging Difficult Employees (Sherman)

Employers need to be cautious when disciplining or discharging certain employees who, for example, filed a worker’s compensation claim, complained about overtime violations, or requested an accommodation for a disability.  However, employers have a right to make business decisions despite any such protected activity or status.  Learn best practices for disciplining and discharging even your most difficult employees with relative safety.

10:40-11:15 – Essential Handbook Clauses You May Need to Revisit (Taurick)

If you haven’t revised your handbook in the past five years, you may need to do so!  This session will discuss newly-required handbook provisions, ones that may not be required but may be advisable due to new laws or agency actions, and those that have faced increased scrutiny in the recent years from agencies such as the NLRB.

11:15-11:45 – Preparing for the DOL’s New Regulations on Overtime Exempt Status in 2016 (Sherman)

If the DOL’s proposed new FLSA regulations go into effect in 2016, as many expect, employers can expect nearly 5 million fewer exempt employees. Learn how these changes will drastically impact employer pay practices and what employers can do now to prepare.
