Legal Authority, Roles & Responsibilities of Local Wetlands Boards

Northampton Wetlands Board investigating unpermitted wetland activity.

A workshop will be held at VIMS on Thursday, May 5th with a focus on Local Wetlands Board issues and concerns.  This event will provide an educational opportunity for all shoreline management stakeholders to learn about the legal challenges and strategies for reviewing permit applications, conducting public hearings, implementing the living shoreline preference policy, requiring wetland compensation to achieve no net loss, enforcement and compliance, investigating violations, and how to balance sometimes competing public and private interests.  Invited speakers and panelists include legal experts from the College of William & Mary's Virginia Coastal Policy Center, Local Wetlands Board members, local government staff, and representatives from the Virginia Marine Resources Commission (VMRC).

"Coasts are dynamic and complex places. Not only do shorelines change and dunes shift but coastal uses - from recreactional to environmental to commercial to national defense -- also greatly differ.  Accordingly, the legal and policy issues surrounding our coastal areas reflect this complex reality, involving property law, environmental law administrative law, constitutional law..., and local government law.  Private property rights.  Wetlands protection.  Hazard mitigation.  Public access.  The list of legal questions that arise where our waters meet our lands is long and constantly evolving."  - William & Mary Law School - Virginia Coastal Policy Center
