This program will address current trends in negligent credentialing from the perspective of both in-house and outside counsel. 

Ms. Kimberly DeLine will tackle the misperception that hospitals’ and physicians’ interests align frequently when it comes to credentialing. In reality, conflict is common and can lead to substantial litigation and costs for all involved especially when a physician is denied privileges or loses his or her privileges. From Ms. DeLine, attendees will learn about the “top 10” types of credentialing disputes that erupt between a hospital and a physician. She will discuss the dynamics that fuel such conflicts and exemplary cases. To assist the practitioner when litigation ensues, she will discuss the “do’s” and “don’ts” of representing physicians who are denied privileges or lose privileges. 

Mr. Michael Callahan will explain environmental factors driving the intense focus on credentialing and re-credentialing in litigation in recent years. Through a discussion of key cases, attendees will learn about the comparatively new tort of negligent credentialing, including various sources of law and professional standards that inform credentialing duties and common types of causation challenges. Next, Mr. Callahan will teach attendees some recent trends in negligent credentialing litigation across the country. Among other things, he will discuss how to maximize protections under credentialing, peer review, or other statutes during the discovery phase of litigation.
