The U.S. Department of Labor recently issued significant changes to the rules exempting certain employees from overtime pay under the Fair Labor Standards Act. Effective December 1, 2016, most businesses and nonprofit organizations will be required to make a number of major adjustments in the way in which they handle their "exempt" employees and pay overtime. Here are just a few of the issues that will be addressed in the seminar:
  • What determines if a nonprofit employee is "working" or "volunteering" their time at a fundraising activity?
  • How will employers deal with the changing workplace culture and potential morale issues caused by the new rules?
  • What legal options do employers have as an alternative to paying excessive or unaffordable overtime?
  • What practices can employers utilize to minimize overtime liability, i.e. adjusting salaries to meet new exemption thresholds; reducing salaries and work hours to avoid additional payroll costs; reducing other employee benefits (health insurance, profit sharing, vacations)?
