"Indiana Digital Asset Estate Planning

This presentation will compare the Indiana version of the Revised Uniform Fiduciary Access To Digital Assets Act (RUFADAA) which became effective July 1, 2016 with the provisions of RUFADAA as promulgated by National Conference of Commissioners on Uniform State Laws.
The presentation will also discuss the various changes to the Indiana probate, guardianship, trust, and power of attorney statutes to harmonize them with RUFADAA as well as the potential consequences of the recent decision of the Ninth Circuit Court of Appeals in United States v. Nosal, - F.3d -, Nos. 14-10037, 14275 (9th Cir. 7/5/2016) concerning illegal password sharing.
The presentation will conclude with sample language to be included in client estate planning documents and a review of potential mistakes to avoid in advising clients about how to provide for such assets in their estate planning.
