After three years of review and iteration on proposed modifications and amendments to the RMP Rule (40 CFR 68), EPA announced on December 21, 2016 the FINAL RULE. The 372-page Final Rule will soon be published in the Federal Register and become mandatory after 60 days, if not rescinded by appeal. The RMP modifications and amendments address new requirements for third party audits, incident investigations, emergency preparedness and response, and information sharing with the community, which will affect every covered facility.
Guest Speaker at each of these special Forums will be Mr. Mark S. Dreux, a nationally recognized expert Attorney in occupational safety and health law and Partner at Arent Fox LLP in Washington, DC. Mr. Dreux's presentation discuss the EPA's new RMP Rule, how it impacts your business, and the necessary steps and timeline to comply.
Over the last 20 years, Mark has defended employers in 30 fire and explosion incidents, 105 fatality investigations, and hundreds of citations alleging violations of the general duty clause and OSHA/EPA standards, particularly, PSM, RMP, lockout/tagout (LOTO), hazard communication (HAZCOM), emergency response, permit-required confined spaces, personal protective equipment, recordkeeping, and machine guarding. From 1984 to 1987, Mark was a federal prosecutor, and he frequently combines his extensive knowledge of criminal and OSHA/EPA law to defend employers in regulatory citations and enforcement proceedings. Recently, Mark was recognized by EHS Today as one of the 50 most influential leaders in the field of occupational safety and health.
