In construction defect and other matters, circumstances arise where Reservation of Rights or other coverage issues reduce the indemnity dollars that potentially could be available for settlement or verdict satisfaction purposes. Insurance defense counsel are sometimes faced with the situation where they need to advocate for indemnity dollars to protect their client from money coming out of business or personal assets and in doing so need to be careful that they are not crossing over into the area of providing coverage opinions which is outside their retention scope.
This CLE will review the tripartite relationship, note real world examples, and provide attendees with suggested approaches for ethically and appropriately advocating for indemnity coverage for their clients.
