Hangout with Rudner MacDonald: Assessing Notice Periods and Severance Obligations

When it comes to dismissals, there is no shortage of questions.

How much "severance" are you entitled to? Can the employer provide working notice? Is the employee entitled to anything more than the applicable employment standards legislation? What is "just cause" for dismissal? What is the difference between "termination pay", "severance pay", "reasonable notice", and "severance"? Is there a difference between being "fired", "let go", "dismissed", etc.?
 
When employers get it wrong, they expose themselves to liability. And when employees do, they often fail to enforce their rights and receive what they are entitled to. Employment Standards legislation is only one small aspect of employment law. Abiding by the terms of the legislation does not mean that all rights and obligations have been fulfilled. Furthermore, the Ministry of Labour will only advise you on the legislation, which means that their advice does not cover the common law, Human Rights, and all other laws which may apply and impact their rights and obligations of the parties substantially.
