TOPICS:  Employment Taxes and the Trust Fund Recovery Penalty and IRS Summons Power

Seminar Description:  This seminar will consist of two topics of interest and importance to tax professionals.  The first focuses on the Trust Fund Recovery Penalty.  The second topic examines the power of the IRS to issue summonses  in investigations and legal proceedings. 

Learning Objectives:

Employment Taxes and the Trust Fund Recovery Penalty (TFRP)

  • What is the normal process of collecting and depositing employment taxes?
  • How do trust fund problems arise?
  • Who can be subject to the TFRP penalty?  
  • What are the key elements required to be a responsible party?
  • What part do control of financial decisions and willfulness play in identifying a  responsible party?
  • What are the administrative procedures surrounding assessment and collection of the TFRP?
  • Can the penalty be abated?
  • How does bankruptcy affect the TFRP?

IRS Summons Power

  • In what circumstances are summons issued and to whom can be they issued?
  • What is the IRS Authority for issuing summonses?
  • What notices are required when a summons is served on a third party?
  • How are summonses enforced?
  • How can a summons be challenged?
  • How does a subpoena differ from a summons?
  • How are search warrants used as investigative tools?

OUR FEATURED SPEAKER

Michael J. DeBlis, III, Esq, Partner, DeBlis Law, Bloomfield, NJ

Mr. DeBlis specializes in assisting U.S. persons to come into compliance with their U.S. international reporting obligations, including shepherding them through the Offshore Voluntary Disclosure Program (OVDP) and the Streamlined Procedures. He maintains a vibrant criminal defense practice, defending clients who are charged with crimes in both state and federal court.  Prior to joining DeBlis Law, Mr. DeBlis  worked in the 
New Jersey Office of the Public Defender, representing indigent clients who were charged with indictable crimes.

Mr. DeBlis has a law degree from the Thomas M. Cooley Law School and an LL.M. in International Tax & Financial Services from the Thomas Jefferson School of Law.  He is a member of the White Collar Crime Committee, National Association of Criminal Defense Lawyers and the Committee on Civil and Criminal Tax Penalties, Section on Taxation of the American Bar Association.   He has written articles published in the CCH Journal of Tax Practice and Procedure, the EA Journal, and Trial Lawyer magazine and has conducted tax and legal webinars hosted by CPE Link, Lawline and the ACPEN Tax Institue.

Mr. DeBlis has been named to Super Lawyer’s “Rising Stars” list in New Jersey for the second year in a row.
