Medical & Business Asset Protection

You work hard for the money, so it's only logical that you should want to protect it.

Although every physician's worst nightmare is being wiped out as a result of a medical malpractice judgment, that rarely happens. Typically, these lawsuits are settled before they ever go to court, and even if a judgment is handed down, the damages are often capped at your policy's coverage limits.

More likely tugs-of-war over your assets involve nonmalpractice litigants (ex-spouses; business and investment partners; others alleging injuries related to a car accident, labor issue, or contractual dispute), the IRS or a bankruptcy court.

Join our presentation to see the best way to protect your business or medical practice.

"On March 13, 2014, the Florida Supreme Court handed down a ruling
(Estate of McCall v. United States), that held the cap on non-economic
damages in medical malpractice cases (which was the centerpiece of the
2003 medical malpractice overhaul law) violates the Florida
Constitution's Equal Protection clause.  To clarify, non-economic
damages are those nebulous harms such as "mental anguish, emotional
pain and suffering, loss of companionship, loss of consortium, or
other nonpecuniary injury."  From a practical standpoint this means
that a Florida physician sued for malpractice could now face a
multi-million dollar judgment.  In fact, the McCalls were awarded 2
million dollars in non-economic damages alone.  This makes protecting
assets even more important to physicians practicing medicine in

We live in a society where a combination of economic uncertainty
and a sue happy populous put not only physicians at risk of being
sued, but business owners in general.  Please join us for an
educational seminar designed to give you an overview of the tools you
need to protect your personal and business assets.  Our speaker,
attorney Adam O. Kirwan, J.D., LL.M., is the author of the book, The
Asset Protection Guide for Florida Physicians, and will provide a
comprehensive, unbiased  overview of this topic including:

1. How to make sure homestead is actually protected;

2.  What to do if you have already been named in a law suit;

3.  How to protect your future earnings, including distributions that
are not protected under Florida law;

4.  How to use Florida’s generous state law exemptions to protect your
assets and the often undiscussed exceptions to these rules that could
leave you unprotected;

5.  How trusts, family limited partnerships, and other domestic
entities can protect assets and the upsides and downsides of each."
