The HCBA's Federal Practice Committee presents: Demystifying Computer-Assisted Discovery

New technology is changing the way that lawyers sort through large numbers of documents during discovery. "Predictive coding" and similar tools are bringing efficiency to document review, but also bringing new vocabulary to new disagreements among lawyers, and raising new questions about how to best find the relevant documents. We will address some of these new questions:
How does technology-assisted review work? What are its advantages and disadvantages? What does the lawyer need to understand about the software? What is the nature of modern discovery disputes? What is the new language used in those disputes? This program will define and walk through the key concepts - automation, analytics and predictive coding - to leave attendees with a better understanding of their options as well as provide a framework for meeting ethical requirements of competence in using these processes. We will also review the latest case law, much of it originating in the federal courts in New York.
