Anatomy of Trust and Estate Administrations

Program Description:
This two part program will include a presentation by Stacie Polashuk Nelson on the timing and process of an administration both for a probate and a trust, including the waiver and release and what it means. This presentation will be followed by a panel discussion of best practices regarding trust and estate administrations and potential litigation, including public relations considerations and donor intent.

Stacie Polashuk Nelson, Esq., Partner
Holland & Knight, LLP
Stacie Polashuk Nelson is a partner in Holland & Knight's San Francisco office  and is a member of the firm's Private Wealth Services Group. Since 1998, Ms. Nelson has concentrated her practice on all aspects of contentious trust, estate and conservatorship matters. Her practice includes will and trust contests, accounting disputes, disputed conservatorships, breach of fiduciary duty matters, financial elder abuse matters, as well as trust and estate administration. She is an experienced trial attorney, but she is dedicated to finding the best resolution for the client, including client counseling, mediation, settlement negotiations and/or trial. Her administration practice focuses on assisting clients with post-death administration of trusts and estates and securing and protecting bequests made to individuals and charitable beneficiaries. Ms. Nelson’s clients include charities, individuals, families, and professional and institutional fiduciaries.

Barry Stenger, Executive Director
St. Anthony Foundation
Barry Stenger serves as Executive Director for St. Anthony Foundation. He has  been at St. Anthony’s since 2005 and was at the helm of its Development efforts until 2012. He has had key responsibilities in two successful capital campaigns and the organization’s strategic planning processes. As Executive Director, he continues his fund raising work, has revamped the executive management team and, with its new campus, is guiding the organization toward its eighth decade of service to San Francisco’s poor and low income residents. He has brought a variety of skills and a depth of experience to the work of the Foundation. He has been the director of a charitable foundation, a professor of social ethics at Santa Clara University and the Graduate Theological Union, the director of The Center for Ethics & Social Policy in Berkeley and a pastor of a Catholic parish in Las Vegas, Nevada.  He holds a Doctor of Philosophy degree in Social Ethics from the University of Chicago. Barry is a third generation Oaklander and still lives there with his wife and daughters.

Julie Carlevaro, Estates and Planned Gifts Associate

Julie Carlevaro joined Earthjustice in 2015 and currently serves as the  Estate and Planned Gifts Associate, managing the organization’s estate gift and split-interest programs. She has also helped developed stronger policies for the administration of estate gifts and has played an active role in the  management of new, contested, and lapsed estate gifts. She also administers the Earthjustice’s growing split- interest gift program. Prior to this, she spent fifteen years as a teacher and director for the non-profit organization, Marin Day Schools. A native of the San Francisco Bay Area, she has her undergraduate degree from San Francisco State University.

Tom Horton, Vice President of Philanthropy
Guide Dog for the Blind
Tom Horton was Guide Dog for the Blind's planned giving director for 15 years priorto taking on the role of VP of Philanthropy. Tom leads the Development Department team, overseeing all aspects of GDB's fundraising efforts including planned giving, corporate and foundation giving, special events, major gifts, direct mail and online giving, and donor relations and stewardship.

Prior to entering the gift planning field more than 20 years ago, Tom practiced law in the Boston area. He attended Boston College as an undergraduate and attended Boston College Law School and University of Utah College of Law. He is a member of the California, Massachusetts, and Washington Bar Associations and served on the Board of the Northern California Planned Giving Council. Tom is past president of the San Francisco Estate Planning Council. He is on the faculty of the UC Berkeley Extension where he teaches a course titled "Philanthropy as a Wealth Management Tool." He lives in Oakland, Calif. with his wife Michelle and son Matt.

Estate Planning to Fulfill Donor Intent and Prevent Unintended Consequences 

Program Description: 
Bequests are crucial to a charity’s ability to provide services and programs to its beneficiaries. Well-intentioned bequests can sour for any number of reasons – the charity beneficiary goes out of business, a relative challenges the donor’s competency, the gift has a restricted purpose that the named charity beneficiary can’t fulfill, etc. In this interactive session, we will review the basics of estate planning and learn planning tips that planned giving officers, wealth advisors, accountants, and estate planners can use to ensure the intent of their donors and clients is fulfilled.

Sarah M. King, Partner

Ms. King is a partner of Stephenson Kasper & King, LLP (formerly Tufts Stephenson & Kasper, LLP).  Ms. King specializes in estate and family wealth planning, estate tax planning, business succession planning, trust and estate  administration, probate law and charitable planning. 

Prior to joining Stephenson Kasper & King, Ms. King was a Litigation Director and Shareholder at Howard Rice Nemerovski Canady Falk and Rabkin in San Francisco, a litigation associate at Paul Weiss Rifkind Wharton & Garrison in New York, and law clerk to the Hon. Warren J. Ferguson of the United States Court of Appeals for the Ninth Circuit. 

Ms. King received her J.D. degree from Stanford Law School, and an LLM in Taxation from Golden Gate University. She is licensed to practice law in California and New York.

Ms. Kasper is a partner of Stephenson Kasper & King, LLP (formerly Tufts Stephenson & Kasper, LLP).  Ms. Kasper’s practice focuses in the areas of estate tax planning, estate and family wealth planning, trust and estate administration, advice to trustees and beneficiaries, probate law, charitable gift planning, and representation of tax exempt organizations.  Prior to founding Tufts, Stephenson & Kasper LLP in 1999, Ms. Kasper was a partner in the law firm of Jackson Tufts Cole & Black, LLP, initially as a litigation attorney and later as a trusts and estates attorney. Before private practice, Ms. Kasper also served as a Trial Attorney in the Commercial Litigation Branch, Civil Division, U.S. Department of Justice, and as a law clerk to the Honorable John W. Kern, III, District of Columbia Court of Appeals. Ms. Kasper worked as a legislative assistant to two Members of the U.S. House of Representatives before and during law school.Ms. Kasper obtained her J.D. degree cum laude from Georgetown University, and her B.A. degree magna cum laude from Duke University. She is licensed to practice law in California and the District of Columbia.
