Bill 142, Construction Lien Amendment Act

The new Construction Act is now law, with portions of it coming to force on July 1, 2018.  The Construction Act modernizes construction liens and trusts rights, imposes a requirement for prompt payment, and introduces adjudication as the way to resolve project disputes in real time.   Join Sandra Astolfo and Faren Bogach, two construction lawyers from WeirFoulds LLP as they walk you through the key features of the new legislation, focusing on how the Construction Act is going to affect the way subcontractors and suppliers do business.  This program will help you identify the risks and benefits of the new Act and provide you with tips to help you get paid!

Faren H. Bogach, Partner, WeirFoulds LLP

Faren has significant expertise litigating a broad range of complex business disputes and works with clients from across the construction pyramid including owners, contractors, consultants, subcontractors and trades.. She has experience with project strategy, as well as, lien, trust, contract, procurement, professional negligence, and delay claims.

 As an advocate for practical approaches to disputes, Faren is able to identify issues in a potential dispute early and work with her clients to provide innovative solutions. She is dedicated to guiding her client through the whole construction process from contract negotiation through to litigation. It is this approach that has led to Faren successfully resolving her clients' construction related issues.

 She has acted as litigation counsel in complex construction disputes, and has appeared before all levels of court in Ontario, and the Federal Court.

 Faren is committed to the construction industry in Canada, and is a long-standing member, and former director of the Canadian Association of Women in Construction. She has also taught the Law and Construction Contracts course at George Brown College, School of Construction Management and Trades, and School of Architectural Studies.

She represents her clients in prosecuting and defending lien and breach of trust claims, construction product liability claims, construction industry receiverships and assists clients with negotiating and drafting construction contracts.
