The purpose of this roundtable will be to discuss what appears to be a new tactic by certain plaintiff attorneys to try to create conflicts between defense counsel, clients, and carriers. The letters recently sent by certain plaintiffs’ counsel suggesting that there are irreconcilable conflicts between insurance defense counsel and an insured third party defendant may be a trap for the unwary. The purpose of this roundtable will be to discuss how to prepare in advance for these tactics, what actions to take once the letter is received, and to make sure that all of us—including young lawyers—are aware of the pitfalls and dangers of a hasty response.
