In light of the unique laws applicable to settlement of employment law matters, defense attorneys must tread carefully when resolving employment disputes so that employers do not run afoul of labor and tax laws. Some aspects of settlement, such as payment of wage claims, can be particularly difficult for employers and their defense counsel in light of potential insurance coverage issues. This panel discussion by two experienced labor and employment law attorneys will provide defense counsel with guidance on potential settlement strategies and ethical considerations when defending insured entities in employment disputes, including addressing recent statutory changes to settlement of sexual harassment claims and particular considerations for such claims.
