Presentation Summary
This month we are honored to feature Judge Carchman who will talk with us on Judicial Ethics: On & Off the Bench.
This course is designed for lawyers in all practice areas and levels.
While the judiciary is one of three branches of our tri-partite form of government, the public perceives the judiciary as different with an expectation that judges will conduct themselves both on and off the bench in a way that is different from those in the executive or legislative branches of government. Judges are not generally seen as politicians but as those charged with the responsibility of ensuring fairness in the judicial process to the end that decisions reflect the goal of achieving justice in every case.
Judges are subject to a separate ethical code from lawyers and those in the other branches of government. The Code of Judicial Conduct governs a judge's conduct in both a judge's professional capacity and private life, and New Jersey's version of the CJC imposes the strictest limitations in the country on judges activities off the bench.
This lecture will explore the ethical constraints on judges with an emphasis on extrajudicial conduct. We will explore the CDC as well as cases that have addressed ethical issues as applied to judges as well as their personal and professional relationship with the public and specifically, the lawyers that they deal with on a daily basis.
The lecture will be interactive with participants deciding ethical issues presented by a series of hypothetical problems.
About Our Speaker
Following a judicial clerkship and service as a Deputy Attorney General, Judge Philip S. Carchman was a member of the Newark and Princeton law firm of Carchman, Annich, Sochor & Shuster from 1967 to1981. During that time, among other clients, he represented Princeton University, the Princeton University Press and the Institute for Advanced Study.
Judge Carchman started his judicial career in 1973 when he was appointed to the part-time position of Municipal Court judge of Princeton Township and Princeton Borough. In 1981, Governor Brendan T. Byrne appointed him to the office of Mercer County Prosecutor, and he served in that position until 1986 when Governor Thomas Kean appointed Judge Carchman to the Superior Court of New Jersey. During his judicial career, he has served as presiding judge of the civil, family and general equity divisions.
In 1995, he was appointed by Chief Justice Robert Wilentz to serve as assignment judge of the Mercer vicinage. Chief Justice Deborah Poritz appointed Judge Carchman to the Appellate Division in 1997. From 2004 to 2008, Judge Carchman took a leave of absence from the Appellate Division and was appointed the Administrative Director of Courts, where he served with three Chief Justices - Chief Justice Deborah Poritz, Chief Justice James Zazzali and Chief Justice Stuart Rabner. He returned to the Appellate Division in 2008, where he served until 2012 when he retired and went on recall status. He has authored over 1200 written opinions.
Judge Carchman has sat in every judicial position in New Jersey including temporary assignments to the Supreme Court.
Judge Carchman graduated from the Wharton School of the University of Pennsylvania and obtained his law degree from the University of Pennsylvania Law School.
