Simply stated, done right, employee handbooks provide employers with an important shield to defend against or possibly avoid employment claims, including claims of harassment, discrimination or wage and hour violations.
Unfortunately, many times, employers simply take templates from the internet or use an old form to prepare their employee handbooks without taking into account the specific policies and needs of their respective organization. In those situations, a poorly crafted handbook can be used as a sword by opportunistic plaintiff's employment lawyers to argue that an employer’s actions are inconsistent and, thus, evidence of an unlawful motive.
It is critical that employers review their handbook every year to ensure that the policies in their handbook keep up with their actual business practices and constantly changing employment laws.
