This CLE will focus on defending property damage bad faith claims in Colorado and how the influx of out of state public adjusters has impacted both claims adjusting and litigation. Since 1115/1116 was passed, the amount of bad faith litigation resulting from hail, wind and fire claims has grown significantly.
Early assessment of coverage disputes over code upgrades, overhead and profit, and matching is vital when analyzing delay exposure. The speakers for this CLE will explain the obligations of the insured under the policy. The CLE will address the implication of failures to cooperate and/or misrepresentation under policy terms may apply to the conduct of public adjusters.
This CLE will address issues pertaining to policy language regarding use code upgrades. The CLE will discuss "matching" issues that arise in the adjustment of these claims and how such issues may often be illegitimate attempts to inflate repair costs and cover public adjuster's 10-15% fees.
The speakers will discuss the recent opinions on the standard of review of an appraisal award in both state and federal court, and the admissibility of the appraisal award in the bad faith case.
