How do time limit demands present risks to carriers when defending third party liability claims? How can a carrier best respond to a time limit demand and demonstrate that the claim was responded to diligently, reasonably, and fairly? This session will provide tools and information to respond to time limit demands and help minimize the risk of an action for extra contractual liability.

This will be an ethics presentation for claims handlers and attorneys in the context of professional liability claims. We intend to discuss the applicability of the attorney-client privilege during internal investigations by attorneys, compliance with wiretapping laws, and other ethical issues that arise during claim investigations. Panelists will address various hypotheticals and discuss an overview of the attorney-client privilege, the ethical rules regarding the duty to maintain confidentiality, the work-product doctrine, how these privileges can be maintained during an investigation, and circumstances in which the insured may want to waive the privileges.
