2019 Employment Law Changes

WHAT: These three Employment Law topics will be discussed:

Paid Family Leave-   As part of the Grand Bargain passed last year, all companies will have to collect and remit to the Mass Department of Revenue a tax which will fund the new paid family leave program.  The tax is .63% of the wages of an employee up to the fica threshold.  Employers over 25 will have to make the contribution but will be able to deduct 40% of the medical leave and 100% of the family leave from the employee check.  Employers under 25 will have to collect and remit the employee portion but not make an employer contribution.

Section 27- Another provision of the Grand Bargain is that restaurants must now ensure that tipped wait staff earn the minimum wage on a per shift basis.  The prior law required that restaurants ensure that the tipped employee earn minimum wage on a per pay period basis.  This law results in a significant hardship for employers as no current software can handle this task and the calculation must be done manually.   The requirement effectively serves to increase the minimum wage for tipped employees.

EMAC- This past year employers were hit with an assessment of 5% of wages up to $750 per employee for any employee that participates in the Mass Health Program or a subsidized Connector program.  This has resulted in millions of dollars in unexpected and unbudgeted expenses for many Cape companies.  The law is expected to sunset in 2019 however there is no assurance that this will occur.
