Objectives:
- Examine the compliance risks for the behavioral health field, including lessons learned from recent OIG and DOJ settlement reports and risk areas identified in the current OIG Work Plan.
- Steps for creating an action plan for risk prevention, identification, and mitigation will be reviewed.
- 42 CFR Part 2 and HIPAA “hot spots” will be analyzed with best practices discussed. These problematic areas include payment issues, coordination of care, mandated reporting, duty to warn situations, and law enforcement requests for information.
Training Summary:
The presentation will discuss recent headlines in the behavioral health field, recent OIG and DOJ settlement reports, as well as current risks identified within the OIG Work Plan. Using this information, steps for creating a risk assessment will be reviewed. Lastly, a fact pattern scenario with best practices involving “hot spots” with 42 CFR Part 2 and HIPAA will be examined.
Presenters:
Kelly J. Epperson is Vice President and General Counsel at Rosecrance. Rosecrance is a national leader in addiction and behavioral health treatment with locations in Illinois, Iowa, and Wisconsin. As General Counsel for Rosecrance, Kelly provides comprehensive legal services to Rosecrance and its affiliates, including directing corporate activities to protect Rosecrance’s legal interests; assisting with mergers and acquisitions; analyzing novel legal issues that uniquely impact behavioral healthcare providers; researching and influencing legislative changes at the state and federal levels; and positioning Rosecrance to be a legally sound not-for-profit so it can continue to fulfill its mission.
Purvi Shah Khare, J.D., CHC, CHPC, is the Director of Corporate Compliance for Rosecrance Health Network, a nationally recognized behavioral health provider with over 40 treatment locations in Illinois, Iowa, and Wisconsin. She is the Director of Corporate Compliance and the Privacy Officer for all Rosecrance affiliates and entities. Ms. Shah leads her department by overseeing internal and external auditing and serving as a resource for complex compliance and confidentiality issues. She initiated and leads the organizational risk management committees and reports to the Board of Directors.
