Family Legacy Conversations: Ethical Wills

When planning for the future, some families are able to retain their assets and keep the family connected because they add vital conversations to the planning mix. They integrate their values, vision, and family stories. When families engage in this process they learn to do their best thinking and act as a resource for one another. One useful tool is the Ethical Will which defines our values, beliefs, life lessons, and blessings to the next generation. It can be especially useful for philanthropic giving. Participants will be immersed in an Ethical Will writing exercise.

Learning Objectives:

1. The five basic elements of an Ethical Wills.
2. The four pillars of a complete estate plan.
3. Learn how to incorporate philanthropy into an Ethical Will.

Option 1: Crypto 101 and the Basics of Accepting (ROOM 120 - Upstairs)

    Jeremy Monty and Paige Jorgensen of CCS Fundraising will walk you through the basics of what cryptocurrency is and why your nonprofit should not ignore the growing and volatile currency. The presentation will unpack how gifts of crypto have benefited social service organizations and donors seeking tax efficiencies. They will share recommendations for crypto gift acceptance tools and what your organization needs to have in place to accept it. Level: Intermediate

    1. Understanding cryptocurrency and the blockchain.
    2. Why accepting crypto is beneficial for nonprofits and donors.
    3. Best practices for your organization to begin accepting crypto.

     

    Option 2:  Top 10 Best Practices for a Successful Planned Giving Program (ROOM LL17 Downstairs)

    The success of a planned giving program starts with the commitment of the Board of a charitable organization to its fundraising and development initiatives and the adoption of a formal gift acceptance policy.  Whether you are a new to planned giving or a seasoned professional, this session will offer practical ideas to review your best practices, revisit your gift acceptance policy, and understand how staff and board can collaborate in the cultivation of the donor base. There will be an opportunity to share experiences during Q&A. Level: Beginner

    1. Identify and prioritize best practices to be implemented at your nonprofit organization.
    2. Recognize the importance of gift acceptance and gift technique policies.
    3. Understand the basic mechanics and implementation procedures for gift annuities and charitable remainder trusts.

    Option 2: Donor Benefits of Planned Giving (ROOM 120 - Upstairs)

    This presentation will look at impacts to the nonprofit-sector as a result of the Pandemic and the challenges that exist today as a result. The need to rebuild endowment requires charities not to shift focus away from planned giving. Using a broad conversation around the most common types of life-income gifts, the Donor Advised Fund and their benefits to the donor, the presentation will use client experiences and gift examples to facilitate a thoughtful revisit to the benefits of planned giving to help donors accomplish their goals. Level: Intermediate

    1. Understand the different types of life-income gifts and the benefits they provide to individuals.
    2. Discuss practical examples and uses of the different gift types to include: charitable gift annuities, charitable remainder trusts, pooled income funds as well as the donor advised fund.
    3. Discuss opportunities around each vehicle and encourage sharing among the audience.

    Option 2: Protecting Donor Intent (ROOM LL17 - Downstairs)

    In the past few years, there has been an increasing hostility toward charities that sought to enforce their legal rights to receive legitimate bequests by donors. Unfortunately, the media has sometimes mischaracterized common fundraising approaches as “aggressive” and untoward.  An example is outlined in a recent Pro Publica article regarding litigation when family members of donors sought to challenge charitable bequests to St. Jude’s Hospital.

    In this presentation, we’ll look at fundraising and planned giving through the lens of a potential litigation challenge.  We’ll review how courts and others will look at certain gifts.  Attendees will learn to identify when a bequest is likely to be challenged, common legal claims, and how to position the charity for a positive result. Level: Advanced  

    Learning Objectives: 

    1. Understand the possibility that, in death, a planned gift may be met with hostility by family members and others.
    2. Identify situations where extra attention is required.
    3. Provide practical ways to approach certain donors to best position the charity for a positive result.
