Based on the information presented in this course of instruction the student will be able to:

  • Discuss the organizational dynamics of a joint law enforcement investigation involving the Fire Department/Fire Marshal and a Police Department.
  • Identify and understand the duties and responsibilities of law enforcement first responders to a fire scene.
  • Review and understand the fundamental components of a fire.
  • Define and discuss the coordination of multiple agency activity at the scene of a fire.
  • Identify the mission and immediate goals of a Fire Department/Fire Marshal response to a fire scene and the scope of the ensuing fire investigation.
  • Review the assessment requirements of the lead fire investigators with respect to coordination of the follow-on fire containment; the personnel and equipment resources to investigate and define the physical scope of the fire investigation.
  • Understand what a “Cause and Origin” Fire Investigation means.
  • Define the investigative actions necessary for a “Cause and Origin” Fire Investigation.
  • Identify and define the nature of the forensic processing and evidence recovery at a fire scene with an eye to later court presentation.
  • Understand the nature of the Findings to be produced by a “Cause and Origin” Fire Investigation.
  • Identify and understand the ramifications of the discovery of a decedent at a fire scene.
  • Recognize the goals of effective fire/crime scene management and the responsibilities of the fire marshals, police investigators and supervisors responsible for the management of joint Fire/Death Investigation.
  • Identify the mission and immediate goals of the Police response to a fire scene where a body is discovered.
  • Identify and understand the coordination necessary between the Fire Department/Fire Marshal and Police upon discovery of a decedent within a fire scene.
  • Review, define, and understand the basic manners of death as it impacts investigative activity at a Fire/Death scene.
  • Understand the personnel necessary for the preliminary investigation of a death scene contained with a fire scene as well as their responsibilities.
  • Understand the investigative and forensic actions by law enforcement upon discovery of a decedent contained within a fire scene.
  • Discuss and identify the sequencing requirements of forensic processing at a joint Fire/Death crime scene and how forensic processing impacts the sequencing of routine fire or death investigative actions.
  • Utilizing case studies identify and understand the common departmental coordination and investigative mistakes that occur during the management of a joint Fire/Death Investigation.
  • Be able to recognize the forensic investigation from both the standpoint of an Arson Investigation and a Death Investigation necessary to effectively present the case in court.
  • Identify the critical scientific testing for evidence recovered from a Fire/Death scene.
  • Identify and discuss how a joint Fire/Death investigation will be presented in court.
  • Understand the trial expectations upon a fire investigator or homicide investigator in a joint Arson/Homicide investigation.
  • Know and understand the functions and importance of court preparation of an Arson/Homicide case.
  • Recognize and understand the purpose of a prosecutor’s direct examination of a Fire Marshal/Arson Investigator to both charges related to the Fire Investigation and to charges related to the Death Investigation.
  • Identify and Understand the way a defense attorney will utilize cross examination of a Fire Marshal/Arson Investigator to attack not only charges related to the fire investigation, but also undermine charges related to the Death Investigation.  [and vice versa]

Instructor: Philip G. Evans, graduated from Penn State University with a Bachelor’s Degree in Journalism and also a Juris Doctor (Law Degree) from Loyola University Chicago.  He is a military veteran and served in the United States Army Judge Advocate General’s Corps, 1987-1994, as both prosecutor and defense counsel in the 82d Airborne Division, Fort Bragg; United States Army Berlin, Germany; and the United States Army Trial Defense Service.  Phil recently retired after 27 years’ service as Deputy Commonwealth’s Attorney, Norfolk, Virginia, 1994-2021 where he supervised the Adult Violent Crime Prosecution Team for 24 years and personally prosecuted numerous types of violent crime cases to include approximately 150 murder cases which included twenty-five defendants charged with capital murder.  He also taught Criminal Procedure to members of the Norfolk Police Department from 1994-2021.  Phil Evans joined the SRR Training team of professional instructors in 2021, and currently resides in Chesapeake, Virginia.
