2024 Updates to the Mental Health Statutes: How a Guardian Can Be Prepared, by Jonathan Culwell

 In 2022, a comprehensive re-write of the Mental Health laws in Colorado, pursuant to 27-65, passed through legislation that related to the 2021 reformation of Colorado’s administrative agencies overseeing mental health services, delivery, and justice involvement. To ease implementation, rollout of new statutes and regulations were staggered, the final effective dates of which are July 1, 2024. This presentation will focus on those final provisions becoming effective later this year, which will include changes to Short Term Certification, a separate and distinct section for Outpatient Certification, a new pathway to certification for justice-involved persons who qualify for inpatient treatment, a new standard for termination of proceedings, and the rights and privileges of Respondents and Lay Persons. We will wrap some of these new provisions into what we already know about mental health, the new reporting data that is required as of 2023, and the usefulness of a guardian in these contexts. There will be time for questions at the end of the presentation.

 

 

Jonathan Culwell

Jonathan Culwell is the managing attorney at The Mental Health Law Firm, where he focuses his practice representing the legal interests of individuals with severe and persistent mental illness (aka, SMI), he represents fiduciaries and individuals in their interest to seek appropriate care and treatment for “their person” living with SMI. Jonathan also practices in Release after a finding of Not Guilty by Reason of Insanity, restrictions on firearm possession, trust and estate planning and administration, appellate advocacy, and select transactional matters for facilities and providers – all focusing on situations where SMI is a relevant factor.

 A native to Colorado, Jonathan is a board member at NAMI Colorado where he chairs the Public Policy Committee and volunteers as a LawLine attorney, he is a board member of the CGA, and a member of the Elder Law and Trust and Estates Section of the Colorado Bar Association, where he chairs the subcommittee on Mental Health Law. When he is not working or participating in a committee, you will find him practicing kung fu and bonsai (not at the same time), playing a word game, or enjoying a cup of black coffee.
