Setting the Stage and Moving Forward: Understanding How the Legal Framework for Decision Making Shapes Practices in Supporting People with I/DD

Speaker:  Lawrence R. Faulkner, Esq., General Counsel and Director of Corporate Compliance, Westchester County Chapter, NYSARC, Inc.  There will be a review of governing legislation and the “arc” of growing respect for the capacity  of the individual with intellectual and developmental disabilities from 1960’s laws concerned with incompetency, to guardianship, conservatorship, to tailored guardianship, to possible reform of 17-A and, finally, to supported decision making. It is a continuous thread of growing respect for the strengths and abilities of the individual, giving substance to the catch phrase of “person centered planning.”

2:15 – 3:30 pm           Discussion on Guardianship Reform under 17-A and the Future of Supported Decision Making (75 Minutes) – (CLE 1.5):  This panel presentation will provide an opportunity to provide participants with a forum for asking questions and discussing concerns about proposed changes to the 17-A guardianship law, as well as new approaches in supporting people with intellectual and developmental disabilities.
