Individuals establishing a new business should consider protecting their business name and the marks associated with their products/services. This seminar will cover a foundational understanding of United States trademark law which is based on actual usage of the trademark in the marketplace, and not just registration like many foreign countries. This seminar will also cover United States copyright law that applies to virtually all original expressions
that are fixed in a tangible medium, including art and literary works and engineering, architectural, computer code and applications, and advertising. Our country’s patent law is complex and in a state of turmoil. This seminar will describe what is required in a provisional application and the temporary protections it provides, and what is in a formal application such as the important Claims that create actual long term legal protections.

Presenter: J. Clark Martin, SCORE Mentor
Clark has degrees in law and electrical engineering. He is an
Army veteran, assigned for two years to the U.S. Army’s Judge
Advocate General Corp. Clark was a lawyer in Baton Rouge
and then with Vinson & Elkins, in Houston, where he spent
36 years practicing intellectual property law. In the fifteen years
since retiring from Vinson & Elkins, he has continued practicing intellectual property law with Kelly Hart & Hallman and currently semi-retired, out of his home. He now volunteers at SCORE Houston providing assistance with patent, copyright and trademark issues.
